Florida — adult-use ballot

Amendment 3 failed in 2024 (55.9% — needed 60%). Sponsors refiling for 2026 with reworded language. Signature deadline: Feb 2026.

Nebraska — medical implementation

Voters approved medical in 2024. Implementation rules under court challenge — first medical dispensary licenses expected late 2026.

South Dakota — rec retry

Adult-use lost in 2022 and 2024. Sponsor coalition signaling 2028 push, not 2026 — track for early signature drives.

Idaho — first medical attempt

Signature collection in progress for a 2026 medical-only initiative. Currently fully illegal — long odds, but motion is real.

Signature deadlines move fast

Most state initiatives need 5–10% of last-election turnout in signatures, due 4–6 months before Election Day. Miss the deadline and the campaign waits 2 years.

Federal rescheduling is wild card

DEA's Schedule III move (filed 2024) is still in admin-law-judge review. If finalized, every state's tax and banking math changes overnight.

Implementation gap is the new battleground

Voters approve, then the legislature stalls retail rules for 12–36 months. Ohio (2023→2024), Maryland (2022→2023), Missouri (2022→2023). Watch for this in NE and (if it passes) FL.

Federal SAFER Banking Act

Sixth attempt since 2014. Would let cannabis businesses access bank loans and credit card processing. Senate Banking markup expected mid-2026.
